General Terms and Conditions (GTC)

1. Scope of application and contractual partner

These General Terms and Conditions (GTC) apply to all contracts concluded by customers with Couture Belle via the online store www.couturebelle.de.

The provider and contractual partner for all orders is:

For the purposes of these GTC, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Offer and conclusion of contract

The presentation of products in the online store does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

By submitting an order by clicking the order button, the customer makes a binding offer to purchase the selected goods. Receipt of the order is confirmed automatically by e-mail immediately after submission. This automatic order confirmation does not yet constitute acceptance of the offer; it merely informs the customer that the order has been received.

A purchase contract is only concluded when we expressly accept the customer’s offer by e-mail or dispatch the goods within 5 working days.

If the customer does not receive either an order confirmation or a dispatch notification within this period, the customer is no longer bound by the order.

The contract language is German.

3. Prices and terms of payment

The prices stated on the product pages are in euros and include statutory VAT, where applicable.

In addition, shipping costs may apply. These are shown during the ordering process and are also set out in these GTC under section 4.

The payment methods available to the customer are displayed in the online store. Unless otherwise agreed, payment is due immediately upon conclusion of the contract.

If payment in advance by bank transfer is selected, our bank details will be communicated in the order confirmation. In this case, the goods will be dispatched only after receipt of payment.

4. Delivery and shipping

Delivery is made exclusively by DHL.

Orders are processed and shipped within 1 to 3 working days after receipt of the order or, in the case of advance payment, after receipt of payment.

We offer the following shipping methods:

Standard shipping:

  • Within Germany: Shipping costs are €6.99 per order. Delivery usually takes place within 2 to 4 business days after dispatch.
  • EU member states: Shipping costs vary depending on the delivery destination and generally range between €16.00 and €26.00. Delivery usually takes place within 2 to 8 business days after dispatch.
  • Selected non-EU countries: Shipping costs may range up to €39.00 depending on the delivery destination. Delivery usually takes place within 4 to 18 business days after dispatch.

Express shipping on request:
Express shipping is available only upon prior request and must be confirmed in writing by the seller before the order is placed. If approved, shipping takes place on the next working day after dispatch. The shipping costs for express delivery depend on the recipient’s location or country and will be communicated individually.

The shipping costs applicable to the order are shown during the checkout process and must be borne by the customer.

Important notice for deliveries outside the EU:
For deliveries to countries outside the European Union, customs duties, import taxes, or other charges may apply. These costs must be borne by the buyer and are not included in the purchase price unless expressly stated otherwise.

Returns are accepted for orders delivered to Germany, EU member states, the United Kingdom, Switzerland, and Norway. Returns are excluded for deliveries to all other countries outside these regions.

5. Right of withdrawal

Consumers generally have a statutory right of withdrawal for distance-selling contracts, unless a statutory exception applies. Under EU consumer rules, that withdrawal period is generally 14 days from delivery for goods.

Withdrawal policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear declaration.

If you have created a customer account on our website, you may request the return directly through your account. Otherwise, you may request the return by e-mail using the link in your order confirmation to access your order.

Returns

Returns are accepted for orders delivered to:

  • Germany
  • EU member states
  • United Kingdom
  • Switzerland
  • Norway

Returns are not accepted for orders delivered to countries outside these regions.

Return procedure

Once a return request has been submitted and approved, customers in eligible countries will receive access to a return option in accordance with the applicable return process.

The returned item must be shipped back to us within 7 days after the return request has been approved. If the return is not shipped within this period, the return request will be automatically cancelled.

Please note that return shipping costs will be deducted or charged accordingly when the prepaid return label is created, depending on the return process.

Consequences of withdrawal

If you validly withdraw from this contract, we will reimburse all payments received from you, excluding shipping costs where applicable, without undue delay and no later than within 14 days from the day on which the returned goods have been received and inspected by us.

For the reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise.

Return conditions

Returned goods must be:

  • unworn,
  • in perfect condition,
  • in the original packaging,
  • and with all original tags attached and intact.

Returns showing traces of makeup, perfume, stains, other residues, damage, or removed/damaged tags are excluded from refund and return acceptance.

6. Retention of title

The delivered goods remain our property until full payment has been made.

7. Warranty

The statutory warranty rights apply.

The warranty period is two years from delivery of the goods to the customer.

8. Liability

We are liable without limitation for intent and gross negligence as well as for damages resulting from injury to life, body, or health.

In the event of a slightly negligent breach of a material contractual obligation (cardinal obligation), our liability is limited to the damage foreseeable at the time of conclusion of the contract and typical for the contract.

Material contractual obligations are those whose fulfillment is essential for the proper execution of the contract and on whose compliance the customer may regularly rely.

Any further liability for damages is excluded.

The above limitations of liability also apply in favor of the legal representatives and vicarious agents of the provider.

Claims under the Product Liability Act and claims arising from guarantees expressly granted by the provider remain unaffected.

9. Data protection

We collect and process the customer’s personal data exclusively in accordance with the applicable statutory data protection provisions.

10. Dispute resolution

The former EU Online Dispute Resolution platform has been discontinued as of 20 July 2025.

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Quality control

All products are subject to quality control before being shipped to the customer.

12. Final provisions

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

In the case of consumers, this choice of law applies only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has his or her habitual residence.

Should any provision of these GTC be invalid or unenforceable, the remainder of the contract shall remain unaffected. The relevant statutory provision shall apply in place of the invalid or unenforceable provision.
